RTI Act

The Right to Information Act 2005 (Act No. 22/2005) is a law enacted by the Parliament of India, giving citizens of India access to records of Central Government and State Governments. The Act applies to all States and Union Territories of India, except the State of Jammu and Kashmir - which is covered under a State-level law. Under the provisions of the Act, any citizen (including the citizens within J&K) may request information from a "public authority" (a body of Government or "instrumentality of State") which is required to reply expeditiously or within thirty days. The Act also requires every public authority to computerise their records for wide dissemination and to proactively publish certain categories of information so that the citizens need minimum recourse to request for information formally.

This law was passed by Parliament on 15 June 2005 and came fully into force on 13 October 2005. Information disclosure in India was hitherto restricted by the Official Secrets Act 1923 and various other special laws, which the new RTI Act now relaxes.

1. Frequently Asked Question about RTI-2005

The relevant provisions of the Act towards charging fee are as under:

  • A request for obtaining information under Sub-section (1) of Section 6 shall be accompanied by an application fee of Rs.10.00 by way of cash against proper receipt or by demand draft or Indian Postal Order (IPO) in the name of the ‘The Director, CSIR-National Geophysical Research Institute’ payable at Hyderabad, Telangana.
  • For providing the information under Sub-section (1) of Section 7, the fee shall be charged by way of cash against proper receipt or by Demand draft or Indian Postal Order (IPO) payable to the ‘The Director, CSIR-National Geophysical Research Institute’ at following rates:
  • Rs.2.00 for each page (in A4/A3 size paper) created or copied.
  • Actual charge or cost price of a copy in larger size paper.
  • Actual cost or price for samples or models; and
  • For inspection of records, no fee for first hour; and a fee of Rupees 5.00 for each fifteen minutes (or fraction thereof) thereafter.

2. For providing the information under Sub-section (5) of Section 7, the fee shall be charged by way of cash against proper receipt or by Demand draft payable to the ‘The Director, CSIR-National Geophysical Research Institute’ at following rates:

  • Information provided on CD Rs.50.00 per CD; and
  • For information provided in printed from at the price fixed for such publication or Rs.2.00 per page of photocopy for extracts from the publications.

RESPONSIBILITY OF THE DIRECTOR

  • Realizing the vision and mission of the National Laboratory,CSIR-National Geophysical Research Institute.
  • Creating an environment in the National Laboratory conducive to nurturing of innovation and high class R&D and the other S&T activities of the laboratory.
  • Managing the affairs of the National Laboratory as per the decisions of the Management Council.
  • He shall in all matters have powers delegated to him by the Governing Body.
  • Have all the powers as per the by laws made & amended from time to time by CSIR.
     

RESPONSIBILITY OF THE HODs

  • To act as a facilitator for running the R&D/S&T project programmes of the respective Division/Centre, control of job allocation and supervision of Division/Centre's activities.
  • Provide due diligence and efforts to perform high class R&D and S&T activities in the Laboratory.
  • Conduct R&D/S&T activities as per the decision of Research Council and Management Council, under supervision of the Director of the Institute.
     

The R&D organization has three broad categories of employees, the guidelines for whom are given as under:
 

Scientific Staff (Gr.IV) To contribute by research and/or development of new methods or knowledge and/or new techniques.
Technical Staff (Gr.III) To contribute by using existing technical /scientific knowledge or by generating modified techniques and/or applying them for the solution of specific technical problem.
Administrative Staff To provide all the administrative support for the work of the organisation.


Also, the laboratory has supporting staff (Gr. II and Gr. I), who are expected to provide general/skilled support to Scientific/Technical/Administrative Staff by way of running /maintaining infrastructure and services.


Duties of the Controller of Administration

  • Formulate and implement the policies concerning administrative procedures for smooth functioning of the institute.
  • Provide advice to the functional bodies (committees, groups) within the organization.
  • Keep liaison with CSIR on matters related to administration.
  • Provide healthy working conditions and atmosphere to the institute by correct interpretation of rules and laws.
  • Advice Director, CSIR-NGRI on the matters related to administrative nature for decision.
  • Seek instructions of the Director on the matters beyond routine for implementation.

Duties of the Administrative Officer

  • Overall in-charge of the activities in the Administrative sections, that deal with matters like personnel; maintenance, upkeep and security of the institute's property; logistics support; control on the expenditure from administrative angle; etc.
  • Reporting /Reviewing officer for the staff working in administrative block.
  • Execute the power delegated to the Administrative Officer
  • Take over the duties of the Controller of Administration in absence of the position.
  • Undertake the tasks as assigned from time-to-time of non-routine nature.

Duties of the Controller of Finance and Accounts

  • To assist and advise the Director on all financial matters and be responsible for providing support services to all the scientific staff and bench-level-scientists.
  • Active participation in management decisions being an ex-officio member in statutory and other committees like Management Council, Standing Purchase Committees, Standing Disposal Committee, Departmental Promotion Committee, Honorarium Distribution Committee, Estate & Work Committee etc.
  • Liaison and co-ordination work in respect of DACR & CSIR audit parties.
  • Financial concurrence of all the proposals including service matters.
  • To keep liaison with CSIR HQs on matters related to Finance/ Accounts/ Audit.
  • Preparation of REs & BEs, review of expenditure vis-a-vis budget allocation.
  • Preparation of annual account, income & expenditure statement and balance sheet.
  • Scrutiny of pension cases and issue of PPO, retirement /death gratuity, commutation order etc.
  • Implementation of activities related to modernization and computerization of finance & accounts functions.
  • Any other work assigned by CSIR/Director.

Duties of controller of Stores and Purchase

  • Overall in-charge of the activities in the Stores and Purchase sections that deal with matters like purchase of stores, maintenance of stores inventories, write-off of unserviceable items, auction of outdated stores, etc.
  • Reporting /Reviewing Officer for the staff working in the Stores and Purchase section.
  • Execute the policies concerning purchase and stores procedures for smooth functioning of the institute.
  • Provide advice to the functional bodies (committees, groups) within the organization.

DECISION MAKING PROCESS/DELEGATION OF POWERS

The procedure followed to take a decision on various matters is in accordance with the rules and regulations governing the subject matter that are under consideration. In order to arrive at a particular decision for important matters, the Research Council of CSIR-NGRI gives direction of the R&D activities to be conducted by the Laboratory. Such R&D activities of the laboratory are managed by the Director with the advice and a Management Council constituted for managing the affairs of the laboratory.

  • Regarding R&D Activities, Each discipline/area at CSIR-NGRI has a Head of the Department (HOD) who normally takes a decision in process making, in consultation with the Director. HODs also supervise the R&D activity in their discipline. The individual Scientific/Technical/Supporting Staff in each area report to the corresponding discipline Head. The discipline heads are accountable to the Director, who in turns reports to the Research and Management Council.
  • In administration, there are Section Officers for each section who report to Controller of Administration/Administrative Officer. The Director is assisted by a Controller of Administration/Administrative Officer, Controller of Finance & Accounts/Finance & Accounts Officer and Controller of Stores & Purchase/Stores & Purchase Officer who advise the director on all administrative, financial and purchase matters.
  • Various Internal Committees have been constituted which are bestowed with specific responsibility to address specific problems. These committees give their recommendations to the Director, who takes a final decision.
  • The final authority in the decision making process rests with the Director and in certain specified matters, the final authority rests with Director General, CSIR (DGSIR), New Delhi. However, certain powers have been delegated to lower functionaries by the Director.
  • CSIR-NGRI is guided in its activities by its Controlling Authority, i.e. Council of Scientific and Industrial Research (CSIR). Based on its directives, the decisions are taken at Laboratory level by the Head of the Laboratory, i.e. Director.

 1. In regard to all matters concerning service conditions of employees of the Society, the Fundamental and supplementary Rules framed by the Govt. of India and such other rules and orders issued by the Govt. of India from time to time shall apply to the extent applicable to the employees of the Society. Notwithstanding anything contained in the Bye-law, the Governing Body shall have the power to relax the requirement of any rule to such extent and subject to such conditions as it may consider necessary.
 
  2.Director of each National Laboratory shall be assisted by a Controller of Administration, Controller of Finance and Accounts/ Finance and Accounts Officer and Controller of Stores & Purchase/ Stores & Purchase Officers who shall advice the Director on all administrative and financial matters and be responsible for providing support services to all the Scientific staff and bench level Scientists. Directors shall have the power to over-rule the advice of aforesaid functionaries after recording reasons thereof. A report of such cases shall be sent to Director-General.
 
  3.Headquarter-Laboratory CSIR head-quarters. and Directors of National Laboratories would operate under director control of Director General without and intermediate line functionary. The Laboratories would be freed from routine administrative and financial control of the head-quarters. The head-quarters will, inter alia deal with the following matters:

  • Receipt and disbursement of funds from the Government;
  • Appointment of Director/Director Level Scientist;
  • National Mission;
  • International and Inter-agency Scientific Collaboration;

National Geophysical Research Institute (NGRI) is a constituent laboratory/establishment of Council of Scientific and Industrial Research (CSIR) - An autonomous body of India. Hence it is governed by Society Rules and regulations adopted from time to time.

Formulation of policy or implementation thereof :: NIL

1.Research Council

    There shall be a Research Council (RC) comprising:
  • Five external experts, one of whom shall be designated as Chairman
  • Representative of concerned Scientific Departments/Agencies of Government ofIndia
  • Director of the Laboratory
  • Director/Sr. Scientist from a sister laboratory.

    Director General or his representative shall be permanent invitee.
    Members at (i), (ii) and (iv) including the Chairman shall be nominated by Director General. The Secretary of the Research Council shall be nominated by the Director. The Secretariat for Research Council shall be provided by the National Laboratory. The Chairman of RC shall preside the meeting. In the absence of the Chairman, members present shall elect a member to preside the meeting. The term of nominated members of Research Council shall be for a period of three years. The Research Council shall meet not less than two times a year
 
    Functions of Research Council, The Research Council shall:
  • Advise on the formulation of R&D programmes and future directions of activities of the laboratory keeping in view the Five Year Plans, national priorities and opportunity areas.
  • Suggest networking with other CSIR National Laboratories on programmes of mutual interest.
  • Review R&D activities and research programmes and advise on future directions.
  • Advise on fostering linkages between the Laboratory, industry and potential clients.
  • Constitute Selection Committees and Assessment Committees/Peer Groups for selection, merit and assessment promotions of Scientific staff.
  • Any other function as may be assigned by Director General/Governing Body.
  • The Proceedings of the Research Council shall be approved by its Chairman. In the absence of Chairman of RC, one of its members who presides the meeting as Chairman shall approve the Proceedings of the said meeting. The Director-General may amend any of the decisions of the Research Council which shall be binding.

2.Management Council

    There shall be a Management Council for National Laboratory for management of affairs of the Laboratory within the framework of Rules and Regulations, directions and guidelines issued by Society, Governing Body, Director General and the Director.
 
    The Management Council shall comprise:
  • Director of the National Laboratory – Chairman.
  • Four scientists of the Laboratory representing the staff of various age groups.
  • One representative of the technical personnel.
  • One Director level scientist from the same Laboratory or sister laboratory.
  • Head, Research Planning Business Development/Planning, Monitoring and Evaluation of the National Laboratory.
  • Controller of Finance & Accounts/F&AO of the Lab.
  • Controller of Adminstration/Adminstrative Officer of the Laboratory as Member Secretary.
 
    Members at (ii) to (vi) to be nominated by Director-General, CSIR. The term of the nominated members shall be for a period of two years.
 
       All matters at the Management Council meeting shall be decided by the majority view.
       Each member including the Chairman shall have one vote.
       The Chairman of Management Council shall preside the meeting and in the event of temporary vacancy in the office of the Director or absence of Director on account of illness, leave, deputation abroad, etc., the Acting Director of the Laboratory shall be the Chairman of the Management Council. The Chairman of MC shall preside the meeting of the MC and also approve the Proceedings.
       The Management Council shall meet as and when required for effective management of the Lab./Instt. but not less than thrice in a financial year.
 
        Functions of Management Council:
  • To administer and manage the affairs and environs of the laboratory.
  • To write off irrecoverable monetary losses and Stores within the limits prescribe by CSIR.
  • To recommend the resource allocation for R&D activities/facilities of the Lab.
  • To monitor the progress of R&D and other activities of the Lab.
  • To recommend devolution of powers to the Project Leaders for the proper implementation of the projects/activities.
  • To approve contract R&D, consultancy projects and licensing of IPR beyond the powers of the Director.
  • To consider the annual report of the National Laboratory.
  • To constitute selection committees and assessment committees.
  • Any other matter, as may be referred by the Director General.
 
        The proceedings of the Management Council shall be approved by its Chairman. The Governing Body or Director General as its Principal executive Officer may review/amend any of the decisions of the Management Council, and pass such orders as considered necessary, which shall be binding on the Management Council

3.Performance Appraisal Board (PAB)

    For each National Laboratory, its performance shall be assessed at least once in every five years by a Performance Appraisal Board constituted by the DG, CSIR for the specific purpose. Members of a PAB shall be nominated by DG, CSIR and if necessary, DG, CSIR may co-opt any additional member(s).
 
    Constitution of Performance Appraisal Board (PAB), Performance Appraisal Board for each National Laboratory shall comprise:
  • Director General - Chairman.
  • Chairman of Research Council of the Laboratory - Member.
  • Three Directors of CSIR National Laboratories, at-least two from amongst the members of Advisory Board - Members.
  • Two out of other members of the Advisory Board - Members.
  • Three External experts specific to a Laboratory out of which one may be member of RC - Members.
  • Director of the National Laboratory as permanent invitee.
  • The Secretariat for the PAB shall be provided by the concerned Laboratory.
 
    The Functions of PAB:
  • Review and appraise the performance of the National Laboratory.
  • Advise the Advisory Board/Governing Body of the outcome of the review.
  • Suggest the remedial measures to improve the performance of the national laboratory.
  • Any other function as may be assigned by the Advisory Board/Governing Body.
    The proceedings of the PAB shall be approved by its Chairman. The approved Minutes shall be placed before Advisory Board and Governing Body.
    Internal Committees, Various Internal Committees as listed below, have been constituted by Director, CSIR-NGRI to look into specific aspects at CSIR-NGRI.

CSIR-NGRI Library

  • The Library remains open from 9.00 AM to 5.30 PM on all working days (Monday to Friday).
  • A reader, using the library, shall enter his/her name legibly in the register kept at the entrance gate. Private belongings shall be kept outside the library.
  • Silence should be observed in the library. Using mobile/cellular phone inside the library is not permitted.
  • Smoking, spitting & sleeping are strictly prohibited in the library.
  • The readers shall be responsible for any damage or mutation done to the books and periodicals of the library and shall be required to replace such publications or to pay the value there of.
  • After consultation, the reader shall leave the publications on the table & shall not replace the publications back on the shelves.
  • CSIR-NGRI staff can borrow only five books at a time for a period of two weeks. Books of special demand are lent out only for shorter period.
  • Encyclopedias, Dictionaries, Directories and other Reference books shall not be lent out.
  • Current periodicals are issued for overnight loan only. A reader can take not more than three periodicals at a time.
  • Before leaving the library, the reader shall satisfy as to whether the book issued to him/her is in sound condition. If not, he/she shall forthwith bring the matter to the notice of library-in-charge/staff, otherwise the reader is liable to be held responsible for condition of the book.
  • Readers are strictly prohibited to sub-lend the books.
  • Loan of publications may be renewed for a further period of one fortnight provided:
  • (i) Demand for the publication is not received.
  • (ii) Renewal does not exceed three consecutive fortnights.
  • Staff Members may suggest books for consideration for inclusion in the library. Suggestions shall pertain to technical work of their units.
  • Any infringement of the rules shall render the reader to forfeit the privilege of admission to the library and to borrow books from the library.
  • Facility of membership i.e. General, Special, and Institutional is also allowed to non-council members. The photocopies are provided @ 1 Rupee per page.

MEMBERSHIP RULES FOR NON-COUNCIL USERS

CSIR-NGRI Library has a collection mainly on science & technology, which comprises of subject encyclopedias, monographs, conference proceedings, special reports and reviews.

Library holdings also include publications of CSIR laboratories, periodicals in S&T, Annual reports of R&D organizations, Indian Standards, and pamphlets.

On the request of non-council readers, the library facilities were made available to them with effect from 1St October 1993.

Types of Membership

  1. ORDINARY MEMBER:
    • Ordinary members are issued membership cards for which they are charged an annual fee of Rs. 200/- (Rupees Two Hundred only).
    • They are allowed to use the library during office hours without any borrowing facilities.
  2. SPECIAL MEMBER:
    • Special members are allowed to consult the library as well as to borrow two books at a time against their membership card and two borrowers cards. Membership fee for this category of members is Rs. 500/- (Rupees Five Hundred only) per annum.
    • Besides membership fee, each member is required to deposit Rs. 1000/- (Rupees One Thousand only) as a security which is refundable at the time of withdrawal of membership.
  3. INSTITUTIONAL MEMBER:
    • This is open for an institution/company/firm. Annual membership fee is Rs. 1000/- (Rupees One Thousand only). In addition, Institutional member is required to deposit Rs. 2000/- (Rupees Two Thousand only) as a security, which is refundable at the time of withdrawal.
    • Institutional member need to formally nominate an employee who will be the contact person for interaction with the library. On payment of fee, the institute is enrolled as member of the library and issued membership card with three borrowers tickets, which entitles the institute to use library and to borrow three books.

Library Reading/Consulting Hours

Library is kept open from Monday to Friday, except Gazetted Holidays. Library hours are 9.00 AM to 5.30 PM.

Rules & Regulations

  1. Books are issued for a period of two weeks and a fine of Re 1/- (Rupee One) per day will be charged for overdue books.
  2. Special & institutional members are responsible for safety of membership card and the book borrowed against cards. In case of loss of card, Library-in-charge should be informed immediately.
  3. Members are responsible for any damage or mutation done to the publications. Lost or damaged books must be paid for before other books are issued.
  4. To reserve a book one has to fill a reserve slip at the circulation desk.
  5. Library reserves the right to cancel membership of any member who does not comply with the library regulation.
